What has to be determined is whether or not the bequest of one-sixth of the residuary estate to (inter alios) the “Southwark Diocesan Society” fails by reason of the fact that that society was not and is not at the present time in being, at any rate under that name. It is unnecessary to travel through the facts or to deal with all the points which obviously leap to the mind when one has to consider a matter of this sort. It is quite right, as the learned judge has said,
