    CHITTY, J. (after stating the facts, continued):— In my opinion, Ranshaw, as legal personal representative of Willoughby, is entitled to recover the £243 6s. 5d., which represents the balance of the proceeds of sale of the mortgaged property. There was in the mortgage deed an express trust as to the surplus moneys arising from the sale. The surplus moneys were therefore a trust fund, and Willoughby was a trustee for the mortgagor and would be exposed to claims through Scupham. If the Statute of Limitations applied as was contended, the result would be that Willoughby would be liable to pay
