The question for our determination is whether the net which the appellant attempted to seize had been forfeited by force of the 21st section of the Salmon Fishery Act, 1861; and its solution depends entirely upon the construction of that enactment. A net is to be forfeited if it is used in contravention of the section; and it appears to us to be the more rational course not to limit its provisions to cases where a salmon has been actually caught.
