April 17. DR. LUSHINGTON. This case of the Concordia is one of damage, and it was argued before the Court, assisted by two Trinity Masters, on the 17th March. There was a French steamer, the Esther, going down the river Thames, and the Concordia was coming up the river. It appeared that these two vessels were approaching each other nearly end on, and the Concordia did not port her helm but starboarded it, contrary to the directions of the 13th article; and a justification for so doing was stated, and evidence was given on the part of the Concordia that

    COLLISIONLimitation of LiabilityMerchant Shipping Act Amendment Act, 1862 (25 & 26 Vict. c. 63), s. 54.
DR. LUSHINGTON. I would take time to consider this case if I really felt any difficulty as to what is the true solution of the objections raised, but I confess I feel none. I am called upon to construe the 54th section of the Merchant Shipping Act Amendment Act; but, before I attempt to undertake that task, I will state the facts as I understand them from the evidence. I think it is unfortunate that this case, which is a proceeding to entitle the owners to immunity beyond a certain amount, should be left entirely upon the evidence of the
